When the ship sailed from port of loading NAC was valid. When ship arrived at port of discharged, NAC expired. Whether import consignments in such ships can be allowed clearance?

Paragraph 2.17 (a) of HBP 2015-20: "Validity of an import Authorization is decided with reference to date of shipment / dis­patch of goods from supplying coun­try as given in Paragraph 9.11A of HBP Vl and not the date of arrival of goods at an Indian Port".

 

Paragraph 9.11 of HBP 2015-20: “date for shipment / dispatch of import is to be reckoned with reference to "Bill of Lading", in case of trans­portation by Sea”.

 

Combine read­ing of both the above paragraphs makes clear that "effective date" for any shipment / dispatch of import is to be reckoned with reference to "BL," in case of trans­portation by Sea.

 

So, if the date of BL is within the validity of NAC, clearance will be al­lowed.
